Optery, Inc. (“us”, “we”, or “our”) operates https://www.optery.com and https://app.optery.com and https://business.optery.com and https://help.optery.com (hereinafter together or individually referred to as “Service”).
PERSONAL DATA means data about a living individual who can be identified from those data (or from those and other information either in our possession or likely to come into our possession).

We may use your Personal Data to contact you with newsletters and data broker status updates. You may opt out of receiving our newsletters and data broker removal status updates by following the unsubscribe link at the bottom of each email we send or by updating the Notification Preferences section of your Account page. We may also send you required account updates such as billing and account activity confirmations. If you do not wish to receive the required account updates, you must delete your account from the Login & Security section of your Account page.
We may also collect information that your browser sends whenever you visit our Service or when you access Service by or through a mobile device (“Usage Data”).
This Usage Data may include information such as your computer’s Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.
When you access Service with a mobile device, this Usage Data may include information such as the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data.

(k) to provide you with news and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless you have opted not to receive such information.

(n) for any other purpose with your consent.
6. Retention of Data
We will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer time periods.
7. Transfer of Data
Our paid subscription plans provide services for submitting personal information opt out, suppression and removal requests to lists of third-party data brokers and information aggregators (“Removal List(s)”) on your behalf (“Removal Service(s)”). If you purchase a paid subscription plan, as a condition to fulfilling your subscription plan, (i) you must provide your personally identifiable information(“PII”) such as full name, birth year and home address to Optery, Inc. and (ii) Optery, Inc. must send your PII to the data brokers and information aggregators included in the Removal Lists. This information is required by the data brokers and information aggregators in order to locate your record(s) and remove you from their database(s). We cannot control, guarantee or warranty how these third-parties will treat your PII or what they will do with it. By purchasing and maintaining an active paid subscription, you approve Optery, Inc. to submit your PII to data brokers and information aggregators for the purposes submitting opt out, suppression and removal requests. If you do not wish to submit your PII to data brokers and information aggregators for the purposes submitting opt out, suppression and removal requests, then you should not use Optery, Inc.’s Removal Services.
Your information, including Personal Data, may be transferred to – and maintained on – computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction.
If you are located outside United States and choose to provide information to us, please note that we transfer the data, including Personal Data, to United States and process it there.
8. Discloser of Data
We may disclose personal information that we collect, or you provide:
(a) Disclosure for Law Enforcement.
Under certain circumstances, we may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities.
(b) Business Transaction.
If we are involved in a change of control business transaction such as a merger, acquisition or asset sale, your Personal Data may be transferred as a result of the business transaction. However, prior to the close of such a business transaction and prior to the transfer of any Personal Data related to such as business transaction, Optery will provide at least 30 days written notice to all users via email notification providing the option for each user to delete their Optery account in advance of the close of the business transaction thereby preventing the unwanted transfer of the user’s Personal Data as a result of the business transaction.
(c) Other cases. We may disclose your information also:
(i) to contractors, service providers, and other third parties we use to support our business such as internet software and services for customer support, digital analytics, advertising, and email.
(ii) to fulfill the purpose for which you provide it.
(iii) for any other purpose disclosed by us when you provide the information.
(iv) with your consent in any other cases.
9. Security of Data
The security of your personal information is important to us and we utilize a number of technical, organizational, process and physical strategies and tactics to secure your personal information as described in our Statement on Data Security. However, remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

Please note that we may ask you to verify your identity before responding to such requests. Please note, we may not able to provide Service without some necessary data.

11. Your Data Protection Rights under the California Privacy Protection Act (CalOPPA)
According to CalOPPA we agree to the following:

(d) all users are able to change their personal information by updating the personal information fields of your Manage Profile page in your account.
Our Policy on “Do Not Track” Signals:
We do not respond to Do Not Track signals. Third-party technology providers we utilize for our Service may also not respond to Do Not Track signals. Do Not Track is a preference setting some web browsers support to inform websites that you do not want to be tracked.

12. Your Data Protection Rights as a resident of any State in the United States, including California under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA)

Please note, you are entitled to ask us to provide you with this information up to two times in a rolling twelve-month period. When you make this request, the information provided may be limited to the personal information we collected about you in the previous 12 months.
(b) To delete your personal information. If you want your personal information to be removed from our systems, you should delete your account from the Login & Security section of your Account page and all of the information we hold about you will be destroyed immediately. If you make this request, we will delete the personal information we hold about you as of the date of your request from our records and direct any service providers to do the same. In some cases, deletion may be accomplished through de-identification of your information. If you choose to delete your personal information, you may not be able to use certain functions that require your personal information to operate. To delete your personal information, you should delete your account from the Login & Security section of your Account page. If you do not have an active Account with us and are not subscribed to our email newsletter, we do not maintain any personal information about you.
An exception to the immediate deletion and de-identification of user data is by our payment processor service provider Stripe. Stripe’s standard practice is to retain the customer’s purchase transaction data to be able to facilitate refund requests and process dispute claims that may arise after a paying customer has already deleted their Optery account. In practice, this ensures customer’s refund and dispute claims are processed quickly and efficiently. (c) To stop selling your personal information. We don’t sell or rent your personal information to any third parties for any purpose. You are the only owner of your Personal Data and can request disclosure or deletion at any time.
Please note, if you ask us to delete your data, it will impact your experience with us as several functions of our Service will not function without your personal information, and you may not be able to participate in certain programs or membership services which require the usage of your personal information to function. But in no circumstances, we will discriminate against you for exercising your rights.
